Employee Liability When Serving Alcohol Without a Utah Alcohol Server Certificate

Like many states, Utah is serious when it comes to regulating the sales and service of alcohol to the public. In fact, serving alcohol without a valid certificate is considered to be a serious violation that could result in criminal actions against the server and the venue where that server is employed. As someone who serves, or plans to serve, alcohol in the state of Utah, it’s important to know employee liability when serving alcohol without a Utah alcohol certificate.

You are Legally Liable for Unauthorized Sales of Alcohol

Under state law in Utah, if you serve alcohol in a public space or venue such as a restaurant, bar or night club you must be state certified to do so. Servers are required to complete a Utah state-approved alcohol server program within 30 days of being hired to serve alcohol. That certificate must also be renewed every three years. While some employees will cover the minimal cost for training and testing, it is the responsibility of the individual to complete this training and present the certification. 

If you are caught serving alcohol to the public without a state-approved certificate, then you could be arrested. Punishments will vary but you should expect a fine and other potential criminal charges. If a minor is involved in this crime, it could carry a maximum of one year in prison along with those associated fines. These potential issues are easy to avoid but the damage doesn’t stop there. 

Employer Liability 

Your employer will also be held liable if you serve alcohol in a state-licensed venue without a Utah alcohol server certificate. According to the Utah Department of Alcoholic Beverages (DABS), the state can impose additional penalties in the form of fines, suspension or even the removal of the venue’s liquor license. In extreme circumstances, this could result in the temporary or even permanent closure of the establishment and the loss of employment for the other employees and servers who are then punished for the carelessness of a single uncertified individual.  

This is why managers overseeing a venue’s operation should always make sure that each and every server is compliant. Certifications should either be posted on a venue wall or servers should carry proof of their Utah alcohol server certificate while on duty. This will be needed in the event of an inspection that calls for proof of compliance.
